Terms & Conditions
1. Scope
These Terms and Conditions apply to all orders placed through our online shop. Our online shop (www.tauerperfumes.com, Tauer GmbH) is directed exclusively at consumers. Consumers are individuals who purchase goods or services for personal use and not for business or professional purposes.
2. Contracting Party, Contract Formation, and Order Correction
The purchase contract is formed with Tauer GmbH.
By placing products in our online shop, we present a binding offer to enter into a contract regarding these items. You may place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction features provided during the checkout process.
The contract is concluded when you accept the offer for the goods in your cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation email.
3. Contract Language and Record Keeping
The languages available for the conclusion of the contract are: English.
We store the text of the contract and send you the order details and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the internet.
4. Subject Matter of the Contract
4.1 Product Description
The product descriptions provided in the shop are an essential part of the contract.
4.2 Product Images
We would like to point out the following, without prejudice to your statutory warranty rights: Due to different screen settings (e.g., resolution and brightness), slight variations in color between the images and actual products may occur. If you are unsure, please contact us for clarification.
4.3 Customized Sample Set – Selection & Fulfilment Policy
4.3.1 Sample Selection During Checkout
The Customized Sample Set includes five (5) complimentary samples, which must be individually selected by the customer during the ordering process via the sample selection interface provided on the website. The selection must be completed prior to finalizing the order.
4.3.2 No Subsequent Modifications
If the customer completes the order without selecting the five samples, no samples will be included in the shipment. Due to automated logistics and fulfilment processes, it is not possible to add, modify, or substitute samples after the order has been placed and confirmed. Requests submitted after checkout cannot be accommodated.
4.3.3 Availability and Substitution
Sample availability is subject to stock and production constraints at the time of order processing. While we make every reasonable effort to provide the exact samples selected by the customer, we reserve the right to substitute unavailable samples with alternatives of comparable value and category, or, if necessary, to ship the order without substitution. No claims arise from the unavailability of specific samples.
4.3.4 Limitation of Responsibility
Tauer GmbH does not assume responsibility for incomplete or omitted sample selections caused by the customer closing or bypassing the selection interface, nor for sample preferences that cannot be fulfilled due to availability constraints.
5. Delivery Conditions
5.1 Delivery Area
We deliver within the United States, EU and Switzerland.
5.2 Delivery Method
Products are shipped to the delivery address specified during the order process.
We ship exclusively via mail or courier service. Self-pickup is not available.
6. Payment
We offer the following payment methods in our shop:
Credit Card
When placing an order, you will be asked to provide your credit card details. Once verified as the legitimate cardholder, the transaction will be processed, and your card will be charged immediately.
PayPal
To pay via PayPal, you must be registered with PayPal, log in with your credentials, and confirm the payment. The transaction will be completed immediately after the order is placed.
PayPal may offer additional payment options to registered users at their discretion. These options are provided independently by PayPal and do not form part of our contractual offering.
If paying via credit card through PayPal, your card will be charged after the goods have shipped.
Twint
you must be registered with Twint for Twint payments.
log in with your credentials, and confirm the payment. The transaction will be completed immediately after the order is placed.
TWINT may offer additional payment options to registered users at their discretion. These options are provided independently by PayPal and do not form part of our contractual offering.
7. Right of Withdrawal (Return Policy)
You have the right to return your purchase within the period and conditions described in our Return Policy. Execeptions : see our return policies.
8. Warranty and Guarantees
Unless explicitly stated otherwise, statutory warranty rights apply.
Please inspect the delivered goods as soon as possible. If you discover defects, please contact us immediately. Failure to do so may result in your acceptance of the goods despite defects that could have been discovered through proper inspection.
If defects become apparent later, notify us immediately upon discovery. You must return the defective product with a detailed description of the issue. You are responsible for the return shipping costs.
We will provide remedy either by repairing the defect or by delivering a replacement. If these attempts fail, you may withdraw from the contract. This does not apply to minor defects. Price reductions are excluded.
The limitations above do not apply in cases of:
Injury to life, body, or health
Gross negligence or willful misconduct
Breach of essential contractual obligations (cardinal duties)
Where product liability laws apply
For used goods: if a defect appears more than one year after delivery, it is no longer covered under warranty. Otherwise, defects must be claimed within the statutory two-year limitation period from delivery.

9. Liability
Delivery and Risk of Loss
All orders are shipped with signature confirmation required upon delivery. Once the shipment is marked as delivered by the carrier and a signature is obtained, the responsibility for the goods passes to the recipient. We are not liable for any loss, theft, or damage that occurs after delivery has been confirmed by the carrier. If you have concerns about the security of deliveries to your address, we recommend providing an alternative delivery location or contacting your local postal service directly.
We are fully liable for damages caused by us, our legal representatives, or agents:
In case of injury to life, body, or health
For intentional or grossly negligent breaches of duty
Where a guarantee has been made
Under applicable product liability laws
In the case of minor negligence leading to the breach of essential contractual obligations (cardinal duties), our liability is limited to the foreseeable damage typical for such a contract.
Otherwise, claims for damages are excluded.
